  1. Do you have a state statute, policy, MOU, or other written document that established your multimedia *small business environmental assistance program (SBEAP)?  If yes, please explain and provide a link to the document if possible.

    Indiana's original plan submitted on January 14, 1993 and approved by EPA on September 2, 1993 (58 FR 46544) was limited to air assistance.  The Small Business Environmental Assistance Program changed significantly in 1995 when Indiana legislators passed a statute creating the Office of Voluntary Compliance and the Compliance and Technical Assistance Program "CTAP" (IC 13-28).  The Indiana statute extended assistance to all environmental regulations: www.in.gov/legislative/ic/code/title13/ar28/.
  1. How and when did your SBEAP begin offering multimedia compliance assistance?

    The program has been multimedia since 1995.
  1. Does your SBEAP provide confidential services?  Explain. 

    Yes, Indiana Code IC 13-28-3-4 states that "[i]nquiries made to the program and activities and documents of the program that identify or describe an individual facility or operation are confidential, unless a clear and immediate danger to the public health or environment exists.  Information concerning inquiries, activities, and documents of the program that identify or describe an individual facility or operation may not be made available for use by other divisions of the department without the consent of the person who made the inquiry, participated in the activity, or provided the document."
  1. What role does the Ombudsman play?  Does the office address multimedia issues or is it strictly strictly an air ombudsman?  What agency or organization does the ombudsman work in?  Please provide contact information.  
     
    The Ombudsman serves as a liaison to the regulated community to assist them with specific regulatory or permit matters pending with the department. The Ombudsman works in IDEM’s Office of the Chief of Staff, but is considered part of CTAP to ensure confidentiality.

  2. What types of multimedia assistance does your SBEAP provide (air, hazardous waste, solid waste, water quality, air, other)?  Describe.   

    We provide confidential assistance on all media types.
  1. Is your SBEAP’s work prioritized?  If yes, explain (e.g., by media, rule, industry sector). 

    Yes, it is prioritized by upcoming rules, compliance deadlines and analysis of need from the Indiana regulated community.  We also focus on specific industry sectors as we build expertise.  We have individuals with primary responsibilities in each media area (air, land, water and drinking water). 
  1. What percent of your total multimedia assistance effort is delivered through each of the following methods:
    -Direct referrals to appropriate regulatory staff (___%)
    -Personal contact with appropriate media staff (e.g., arranging meetings with regulatory staff from different media, having each program outline their respective rule requirements, following up as needed) (___%)

  2. Describe who actually provides the assistance.  Is the primary role of the SBEAP staff to refer assistance requests to the appropriate regulatory staff or do the SBEAP staff possess the knowledge and experience to provide direct assistance?  Explain the educational background and experience level of SBEAP staff.

    The SBEAP staff possess the knowledge and experience to provide direct assistance.  They have degrees in engineering, science, and environmental management.  Most of the staff have transferred to CTAP from an inspection or permitting role in water, air or waste programs.   The majority of the CTAP staff have 10+ years in a regulatory role before joining CTAP.

  4. Do you have SBEAP staff members with expertise in pollution prevention/EMS, as well as regulatory compliance?

    We have a Pollution Prevention & Recycling branch within our Office of Pollution Prevention and Technical Assistance.  These staff members work with CTAP to incorporate pollution prevention and recycling ideas during compliance assistance visits.  Two CTAP staff members are trained regarding ISO14001 and EMS activities. 
  5. Are there any industry sectors for which you cannot provide assistance or can provide only limited assistance?  Explain.

    No.
     
  6. Where is the technical assistance component of your SBEAP housed (state environmental regulatory agency, Small Business Development Center [SBDC], college or university [not SBDC], other state agency)?

    It is housed within Indiana Department of Environmental Management, which is a regulatory agency. The Office of Pollution Prevention and Technical Assistance is not within a program area and the Assistant Commissioner reports directly to the Commissioner.  The Assistant Commissioner has authority to act regarding confidential assistance.

  7. Where does funding come from for your multimedia SBEAP (air permit fees only, air permit fees plus other sources, task-specific funding, other)?  What are the funding criteria?  Please note that since this could be sensitive information, this is an optional question. 

    Funding for the Office of Voluntary Compliance (which houses the Compliance and Technical Assistance Program) comes from dedicated state funds.   

  8. How many staff does your SBEAP have (using FTE equivalents)?  Does your SBEAP have a documented performance measurement system (system to track data on activities such as web site hits, hotline/telephone assistance calls, mailings, onsite visits, publications, seminars/workshops/trainings, teleconferences/videoconferences, other)?  Describe.

    There are 8 FTEs in CTAP.  We have a confidential database into which all incoming calls are entered; these are then used as a resource for future questions as well as tracking and reporting.  The database records all phone calls, site visits, emails, written correspondences, presentations etc.  We are also able to track web hits.    

  9. What have been the benefits of providing multimedia versus air only assistance?  Have you performed any cost benefit analyses?  Describe your successes.
     
    We are able to provide well-rounded sector assistance programs; doing so allows us to cover all relevant information while on site.  We have not performed a cost benefit analysis, but our response surveys (regarding our assistance) say the cross-program assistance is very beneficial.

  13. What is your advice to other SBEAPs who want to become multimedia programs?  What particular challenges did you face evolving into a  multimedia program and how did you overcome them?

    Urge your customers and trade organizations to speak to their legislators.  Have your agency ask the CAP or Legislative Environmental Council to seek legislation that would create a multimedia program.  Look for funding outside of the air program.
